TERMS AND CONDITIONS

§ 1 Scope
These terms apply to all Zenctuary services, in particular:
- Drop-in bookings, Zencoin bundles and 1:1 sessions
- Memberships (Apprentice & Master)
- Workshops & retreats, Fire & Ice and events
Consumers within the meaning of these terms are natural persons acting for private purposes.
§ 2 Conclusion of contract
Bookings are made via the online system or on site. A binding contract is concluded once the booking is completed. Membership contracts additionally require the signed registration form.
§ 3 Zencoin system
Zenctuary uses internal credit (“Zencoins”). One Zencoin has a value of € 5.50. Zencoins are not legal tender, are personal and non-transferable; cash payout is excluded. Zenctuary may adjust the number of Zencoins required for individual services – Zencoins already purchased retain their monetary value.
§ 4 Validity of Zencoins
Zencoins from bundles are valid for 12 months from the date of purchase, Zencoins from memberships for 1 month from the date they are credited. Unused Zencoins expire thereafter. An extension is only granted for good cause (e.g. illness with a medical certificate). All bookings are based on the Zencoin system; the cancellation conditions under § 5 apply.
§ 5 Cancellation & no-show
- Group classes: free cancellation up to 24 hours before the start. In case of later cancellation or no-show, the Zencoins used expire.
- 1:1 sessions: free cancellation up to 24 hours before the appointment. After that, the Zencoins used expire in full.
- Workshops & special events: cancellation possible up to 7 days before the start. After that, no refund unless the place can be filled again.
§ 6 Studio cancellations & minimum participants
Zenctuary may cancel classes if a minimum of 3 participants is not reached; cancellation takes place no later than 3 hours before the class starts. Zencoins already used are credited back in full; no further claims exist.
§ 7 Membership (Apprentice & Master)
Memberships are fixed-term contracts with monthly payment; the minimum term is stated in the registration form. After expiry, the contract continues indefinitely unless terminated with 4 weeks' notice to the end of the month. The monthly Zencoin credit is issued at the beginning of the billing period.
- Pause: A pause is possible in case of illness (with medical certificate), pregnancy or relocation to another city, limited to a maximum of 8 weeks per calendar year. No Zencoins are credited during the pause; the minimum term is extended by the duration of the pause.
- Late payment: Zenctuary may suspend participation until outstanding amounts are settled. If arrears exceed two monthly fees, extraordinary termination is possible.
§ 8 Fire & Ice
Use of Fire & Ice (sauna, ice bath, infrared) is at your own responsibility. People with cardiovascular conditions, during pregnancy or with other health restrictions should seek medical advice before use. Safety instructions given by staff must be followed.
§ 9 Participation & liability
Participation in all offerings is at your own responsibility. Zenctuary is liable only for intent or gross negligence; liability for damages arising from injury to life, body or health remains unaffected. No liability is accepted for personal belongings.
§ 10 Right of withdrawal (online bookings)
For contracts concluded online, consumers generally have a 14-day right of withdrawal. Contracts concluded on site at the studio are not subject to a right of withdrawal.
- Scheduled bookings: For classes, workshops, retreats, Fire & Ice appointments and events booked for a specific date or period, there is no right of withdrawal pursuant to § 312g (2) no. 9 German Civil Code. Only the cancellation conditions under § 5 apply.
- Non-scheduled services: The right of withdrawal applies to Zencoin bundles and memberships concluded online. If the service begins at the customer's express request before the withdrawal period expires, the right of withdrawal lapses upon full performance; in the event of withdrawal before full use, the customer owes proportionate compensation for the services already used.
§ 11 Changes to these terms
Zenctuary may amend these terms for future contracts. Changes to existing membership contracts are communicated to members at least 4 weeks before they take effect. Members have a right to object; in the event of an objection they have a special right of termination.
§ 12 Place of jurisdiction
For consumers, the statutory place of jurisdiction applies.
§ 13 Final provisions
Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.
